Model Release Form

For businesses to run they need great publicity. They need the public to know them and like them. The public has to want what they have and be willing to buy what they have or else the business will not be successful. That is just how it goes.

Businesses will do different things in their quest for great publicity. Some will advertise on drive-time radio, some will pitch stories to different media, some will try to be part of public service announcements and some will become experts in their fields so that people will trust them.

There are so many different things to do and each is important in order to create a market. Some people will advertise through words and others will advertise through pictures. If businesses are going to use pictures of people they have to have model release forms.

A model release form is a form to authorize publication of images of people. It is a form that gives businesses permission to use people's pictures. If a business were to use someone's picture and did not have a model release form they could get into big trouble.

Sometimes businesses do not need a form if they have posted a picture that is just general and unposed. If it is a picture of people and are not trying to model, they just happened to be in the picture. If it just a plain ol' picture, you probably will not need a form.

It would be pretty hard to get a form from people that you do not know who they are or where they are from. If they are not in the picture to model then you probably should not break a sweat about it.

You would need a form if you had someone in a picture, advertising a product. If they were modeling and holding your product then you would need their permission to use the picture in whatever type of advertising you choose. If you did not then they could get you in trouble for it.

You would also need a form if you had a picture of someone and you referred to that picture in your ad. If you are using them and referring to them in order to promote your product and get people to want to buy it, you have to have their permission. Maybe they do not want to endorse your product or maybe they do not want to have the picture on advertisements. You cannot not use it unless they do not mind.

Another thing you would need to check about picture you want to use is whether or not that picture was released only for certain publications. If it is a general picture but it was released to be used in a certain magazine then you also have to have permission to use it. You cannot not just take it and make it your own.

If you think a certain picture would work wonders for your company because it is so great, and if you think that it would help out your advertising and publicity, it would help to bring in more money, you might want to think twice if you do not have a model release form. It would be a shame to be sued or something and lose ten times more than you ever could have made off of it.

So if you are looking for great picture to use for your advertising, or even if you are taking pictures to use for your advertising, always make sure that you have a model release form. It is a way to be safe and secure. It will help you have good public relations while not being a liability.
